Also, to muddy the waters a bit more... Remember that time Nintendo released a pirated ROM of one of the Mario games on their Wii eShop? I don't mean to say that Nintendo doesn't own the rights of their own games, but it leaves a bad taste in the mouth thinking about Nintendo downloading a ROM from a piracy site and then charging money for it. Anyway Google it if you don't remember.

I'm fairly pro piracy. I consider it unethical for Nintendo to release the same games on every eShop without a way to freely transfer from one platform to another. With today's hardware and connectivity there is no reason why I shouldn't be able to buy a retro game on the Wii or WiiU and not be able to play it freely on my switch without a monthly subscription. I have several late 90s games for PC that still work on my current PC (sometimes with some fiddling required).

That aside, if it's more than ten years old or a couple of hardware generations ago I consider it fair game.
